1. The present Terms and Conditions arrange the relationship between MobilTel EAD (hereinafter referred to as MobilTel) and any person (hereinafter referred to as User) that uses the Internet pages of MobilTel EAD and/or the services provided through them.
2. Within the meaning of the present Terms and Conditions the users shall be of two categories:
2.1. Registered – Users that are registered on the Internet pages of MobilTel by entering a GSM number and/or e-mail address, user name and password. Registration by entering a GSM number may be performed only by subscribers or users of MobilTel.
Users, registered by a GSM number, shall have the right to use additional services and/or promotional discounts intended for the subscribers and the users of MobilTel. 2.2. Unregistered – Users that visit the Internet pages of MobilTel without performing registration.
3. The present Terms and Conditions are published on all Internet pages of MobilTel and shall be deemed accepted by the User with the fact of his entering into the appropriate website of MobilTel. The User shall undertake to use the services in accordance with the requirements of the present Terms and Conditions, as well as with the "Rules for the Use of the Services, Related to Internet Access through the Network of MobilTel EAD".
4. Only Users who have made valid registration on the Internet pages of MobilTel shall be allowed to use the services, provided through them. The registration on the Internet pages as per item 1 shall be free of charge.
5. The use of services through the Internet pages by registration or by sending a short text message (SMS) shall be charged in accordance with MobilTel's prices in force.
6. (added in force from 01.04.2007) When using services, wherein publishing of announcements or any other content is performed on the Internet pages of Mobiltel, it shall be forbidden to violate the copyright and the neighbouring rights, trademarks rights or any other intellectual property rights.
7. (added in force from 01.04.2007) When using services, related to participation of the User in forums, blogs, chat rooms or establishing any other type of communication in the Internet pages of Mobiltel, the User shall undertake to observe the following requirements:
7.1. to place posts written only in Bulgarian language, whereas he shall have the right to use the written symbols of the Latin language only with the purpose of clarifying of the expression, as well as with technological terms, trademarks and brands, idioms and slang. Texts in English or any other language will be edited by the appropriate administrators of the Internet pages of Mobiltel.
7.2. not to place on the Internet pages of Mobiltel any obscene, insulting, slanderous, threatening or other texts and/or images that impair the honour and the dignity of other Users or the good reputation of Mobiltel, including publishing of materials with pornographic content.
7.3. not to place on the Internet pages of Mobiltel any commercial, advertising texts and/or images, as well as off-topic posts.
7.4. to propose new themes or sections in forums, blogs, chat rooms after he has convinced himself in advance in the absence of such that have already been created. For this purpose and for his own facilitation he might use the Search option on the appropriate page of Mobiltel.
8. (added in force from 01.04.2007) Every User that uses services on the pages of Mobiltel shall have the right to express opinion with reference to the present Terms and Conditions through sending a personal message to an administrator of the appropriate page to an e-mail address as indicated in "Contacts" section.
9. (added in force from 01.04.2007) Questions related to the use of the services offered on the Internet pages of Mobiltel may be asked by an User through sending a message via e-mail to the address as indicated in "Contacts" section on the appropriate Internet page of Mobiltel.
10. (added in force from 01.04.2007) Information referring to the ways of use of the Internet pages of Mobiltel, as well as to the services provided through them, may be found in the "Questions and Answers" section placed on each Internet page.
11. MobilTel shall undertake to keep the privacy of the correspondence, as well as to not disclose the created user names and passwords or any other personal information submitted by the persons, without their preliminary consent, except otherwise provided by the regulatory arrangements.
12. MobilTel shall have the right to unilaterally and without notification terminate the access to the provided services if:
12.1. (added in force from 01.04.2007) The User disseminates through Internet, SMS or through usage of services from the Internet pages of MobilTel announcements with advertising, commercial, obscene, insulting and/or threatening texts and/or images, including such on religious, faithful or political basis;
12.2. The User, with his actions, undermines the good name of MobilTel EAD, violates the laws of Republic of Bulgaria, the international acts or threatens the operability of the of the software and technical facilities, through which the services are provided, including of other operators.
13. In case of proven illegal actions as per the preceding item of the present Terms and Conditions and/or in case of request by the competent authorities of Republic of Bulgaria, MobilTel shall have the right to submit to the competent authorities all available information for the actions and the identity of the User.
14. MobilTel shall not be liable in front of the User for:
14.1. Losses, benefits forgone and other damages, caused to the User as a result of using on his part of services through the Internet sites as per item 1, as well as of the impossibility to use these services;
14.2. Failure of the User to use any single service as per item 1;
14.3. Claims by third persons against the User at or in relation to the use of the services;
14.4. (amendment in force from 01.04.2007) The User disseminates via Internet, SMS or through usage of services from the Internet pages of Mobiltel announcements with advertising, commercial, obscene, insulting, slanderous and/or threatening texts and/or images, including such on religious, faithful or political basis, as well as such with pornographic content. In case of proved illegal acts infringing this rule Mobiltel shall have the right to use all technological and legal measures for detecting the infringers and notifying the competent authoritties.
15. The registrations of the Users who, during the last 6 months, have not entered the Internet sites as per item 1 with their proper user names, shall be deleted. The Users with deleted registrations shall have the right, at any time, to register again, while observing the appropriate procedure.
16. MobilTel shall not bear any responsibility if, in case of violations of the operability of the software or technical facilities of other operators in Internet or of the telecommunication connections within and/or outside the country, a registered User cannot use partially or completely the possibilities of the provided services.
17. The User shall undertake to make notification about errors, technical problems and other problems related to the use of the services as per item 1, by a phone call to No. 088 1010 or after registration on the Internet address "Contacts"
18. (amendment in force from 01.04.2007) Mobiltel shall reserve the right to unilaterally change the present Terms and Conditions, as well as the structure of its Internet pages, whereas he shall not be obliged to notify the Users through its Internet page www.mtel.bg.
19. For all issues not provided for in this contract the legislation in force in Republic of Bulgaria shall apply.
20. In case of occurrence of disputes the parties shall make every effort for their voluntary settlement by mutual agreement. If no agreement is reached any of the parties may bring the dispute to a competent court for settlement.
