RULES FOR THE USE OF INTERNET ACCESS AND INTERNET ACCESS RELATED SERVICES THROUGH THE NETWORK OF Mobiltel EAD
A. Subject1. These Rules shall be applicable and valid for Mobiltel EAD (referred to hereunder as Provider) and for everyone using Internet Access and Internet Access Related Services (referred to hereunder as User) through Mobiltel's network resources.
B. Objectives and General Principles
2. These Rules for the use of Internet Access and Internet Access Related Services (hereinafter referred to as the Rules) aim at:
2.1. the proper and reasonable use of the network and its resources and to prevent any actions that deteriorate or hinder the technical and functional opportunities for its use.
2.2. to preserve the established reputation of Mobiltel EAD as a responsible Internet Service Provider
2.3. to preserve the security and reliability of the existing network.
3. These Rules are treated as an integral part of an Agreement for Internet Access Provision between the Users and the Provider
4. The systems and the network of the Provider can be used only for the purposes and intentions not prohibited by the laws of the Republic of Bulgaria and by the international acts, in compliance with the constitutional right of every citizen or legal entity to seek for, receive and distribute information. This shall exclude without limitation the following: illegal distribution of software; prohibited access to systems and resources within the Internet space; distribution of copyright materials without the consent of their author; violation of the rights and the good name of someone else; call for coercive change of the constitutionally agreed order; threats to the national security; distribution in the Internet of materials and communications that are commercial secrets; calling to crimes, fomenting hatred or calling to violation against personality.
5. The Provider reserves its right to disconnect immediately and without notice the access to Internet resources and to stop the use of the Provider's networks by one or more users if
5.1. the network is used to achieve prohibited purposes or intentions
5.2. the Provider decides, on its discretion, that these Rules have been breached.
6. The Provider shall not be liable for any illegal use of the systems or the network nor for illegal contents distributed by its Users or by third parties, as far as it undertakes to provide only technical possibility for access to the resources of the Internet space.
7. The Provider is obliged to keep secret the personal correspondence and not to disclose the content or the e-mail address or any other personal information about the Users of the service without their prior consent unless this is required by virtue of any legal provision.
C. The Network
8. The network of Mobiltel EAD may be used by the User to connect to other networks all over the world by complying with the approved rules for the use of the relevant network and without violating the technical characteristics of the adopted protocols and standards.
9. The User is obliged not to violate or misuse the identification procedures, not to jeopardize the security of any devices, networks or records (activities also known as "cracking" or "hacking"), nor to hinder the use or operation of any other device or network by any other user (activities also known as "denial of service attacks").
10. It is inadmissible to use any applications and programs or to distribute information in a way that overloads the systems serving the network or creating inconveniences or technical problems to third parties.
11. It is inadmissible to make unauthorized attempts for access through the ports to connected Internet devices (portscaning) with the purpose to identify the type and version of the installed software as well as any attempts to acquire control over the relevant devices (backdoor and vulnerability testing).
12. The users who violate the security of the existing systems and networks shall be liable pursuant to the laws.
D. Electronic Communication
13. Upon provision of Internet access the User shall be identified by its username, password and/or user's GSM number. The User shall be responsible for all his/her actions with respect to the use of Internet Access and services related to Internet Access and performed under such username and password and/or user's GSM number identifying the relevant user.
14. It is inadmissible to send large messages as well as messages containing commercial advertisements, political speeches, announcements, etc., via the electronic mail (e-mail) to any third parties who have not explicitly stated that they do want to receive such messages ("junk mail" or "spam").
15. It is inadmissible to send messages containing commercial advertisements, political speeches, announcements, etc., to undetermined number of addressees (also known as newsgroups cross-posting, multiple-posting or "USENET spam").
16. It is inadmissible to send messages from the e-mail address of another person except with the explicit consent of the owner, as well as to falsify any information about the sender.
17. It is inadmissible to forward or distribute the so-called chain letters.
18. These Rules shall be applied to all Internet based environment for information distribution, including to any application working in Internet environment (for example, usenet news, fax through Internet, etc.) the access to which is provided by virtue of an agreement between the user and the Provider, including the cases when a server possessed by any third party is used.
